European patent Validation is a transaction that provides patent protection in European Patent Office (EPO) contracting states with converting the patent to a national patent. With validation, applicant of the patent could obtain patent production in up to 42 member states of EPO. Turkey is one of the members states of EPO which a European Patent could be validated.
Grant of the patent decision is transmitted to the applicant with Notice of Intent to Grant by EPO. Afterward, the applicant has 4 months to translate claims and pay the grant fee to EPO. Subsequently, EPO publishes the granted patent in the European Patent Bulletin.
Time Limit for European Patent Validation
There is a 3 months deadline for granted patent which effective in all contracting states of EPO. With the publication of a granted patent, the applicant has 3 months to validate their patents in Turkey. There could be 3 months extension period for submitting validation without Turkish translation with a surcharge.
Requirements for European Patent Validation in Turkey
When a European patent granted, there is no need for substantive examination or search in order to proceed with validation. Nevertheless, patent validation applications for Turkey should be done by a Turkish residence. In this step, the patent applicant could cooperate with a local IP office like Defans Patent. Among that translation of all patent documents (abstract, description, claims, figures) and Power of Attorney which should be signed by the applicant is sufficient for validation application in Turkey.
Official Fees for European Patent Validation in Turkey
The official fee for a Publication fee of a fascicule of a European Patent (validation fee of a granted European Patent) is 3,095 TRY. In case of a request for an extension for submitting Turkish translation of the European Patent, there is a 1,750 TRY additional fee. There are also annuity fees for maintenance of protection of patent which should be starting to paid with the second year of application and every after year.
