European Patent Validation – What, When and How?

EP Validation is the process of converting a single granted European Patent Application into a national patent in one or more of the 42 European Patent Organization member, extension and validation states. Turkey is one of these 42 states.

According to EPC Art. 65, a granted patent by EPO must be validated by Turkish Patent Office in order to take effect in Turkey. 

The validation process typically involves high quality, technically-qualified translation of all or part of the patent, the payment of fees and the filing of documents within a certain timeframe – usually three months from the European Grant Date.

The actual requirements vary between countries. But in Turkey, the translated copy of the granted patent and the payment to is enough to start the validation process. An exception is applied by Turkish Patent in the revocation proceeding cases as described in EPC Art. 70(3). That is, the original text is used, unless the Turkish translation covers the whole scope.

EP Validation Deadline

The deadline for validation in Turkey has a three months deadline from the European Grant date.

Power of Attorney

We need a signed Power of Attorney from the applicant to present in any time for case related issues within the Turkish Patent Office.

Application Language

The application must in Turkish language. All parts, abstract, description, claims, figures must be translated to Turkish.

The Extension Period

The application language is Turkish but, a three months extension period is given by paying an extra fee during the application to handle the Turkish translation of the EPO granted patent.

Obligation to use

All the validated patents must be commercially used within 3 years, beginning from the national publication date unless the patentee has a valid reason not to do. If there is no valid reason, than a third party could demand a compulsory license usage by a litigation. The license fees also determined by the court in such cases. Compulsory licensing thru Turkish Patent Office by Art. 128 of Turkish IP Law has the almost same effects so usage is the best way to protect the patent validation for 20 years.
